WHAT IS THE PERFECT ESCAPES BEST RATE GUARANTEE?

If you find a Qualifying Lower Rate within twenty four (24) hours after your booking through Perfect Escapes, we will provide you with a refund of the difference between the price you actually paid through Perfect Escapes and the Qualifying Lower Rate.

A Qualifying Lower Rate is a lower rate found on Perfect Escapes, or on another U.S.-based Web site, that satisfies the requirements of these Terms and Conditions, as determined by Perfect Escapes in its sole discretion.

WHEN DOES THE BEST RATE GUARANTEE APPLY?

1. The Best Rate Guarantee applies only to hotel room nights or hotel packages booked on the Perfect Escapes.com Web site.  The Best Rate Guarantee does not apply to hotel room nights or hotel packages accessed through the PerfectEscapes.com Web site but booked through a hotel property’s own reservation system or other non-Perfect Escapes reservation system that is reached through a link from the PerfectEscapes.com Web site.
2. A Qualifying Lower Rate must be both advertised and available to the general public on a U.S.-based Web site, and be immediately bookable.
3. In order to be a Qualifying Lower Rate, the lower rate must be for an identical booking (as further described below), in all cases for the same room and bed type, same dates, and same number of guests:

• If your reservation booked on the PerfectEscapes.com Web site is for room nights only, then only a room-night-only rate offered on the Internet may constitute a Qualifying Lower Rate. A room night rate that is included within a promotional package or bundle that includes other amenities beyond room nights (for example, parking, meals, or entertainment) is not a Qualifying Lower Rate to a room-night-only reservation booked on the Perfect Escapes.com Web site. Likewise, a room night rate that is included as the lodging portion of flight + hotel vacation package, cruise + hotel vacation package, or other such combined vacation package, is not a Qualifying Lower Rate to a room-night-only reservation booked on the PerfectEscapes.com Web site.
• If your reservation booked on the PerfectEscapes.com Web site is for a package or bundle which includes additional amenities beyond room nights (for example, parking, meals, or entertainment), only packages or bundles that you find on the Internet having the identical components as the package or bundle that you booked on the PerfectEscapes.com Web site may constitute a Qualifying Lower Rate. Any variation of components between the packages or bundles being compared shall render the comparison invalid for purposes of the Best Rate Guarantee.
• When multiple rates for the same hotel, reservation dates, and room type are available for booking on the PerfectEscapes.com Web site, you must reserve the lowest available rate in order to be eligible for the Best Rate Guarantee.
• When a stay covers multiple nights, room-night-only rates shall be compared for each night separately.

4. Qualifying Lower Rates do not include rates on Web sites where the identity of the hotel, the rate, or other material booking details are opaque or unknown until after purchase (such as Hotwire or Priceline), or where prices are determined by any sort of auction or bidding.
5. The Best Rate Guarantee does not apply to hotel rooms purchased through, or in combination with, frequent stay, loyalty, points or other reward type programs, hotel rooms purchased through coupon promotions, hotel rooms won through contests or sweepstakes, or room night stays transferred to the user as part of a non-cash or in-kind transaction.
6. Qualifying Lower Rates do not include rates loaded in error by Perfect Escapes, online travel agencies, third party travel re-sellers, or a hotel, or any printing, typographical, administrative or technological errors in any materials relating to the rates.
7. Qualifying Lower Rates shall not include corporate discounts or rates, group rates (such as AAA, AARP, senior citizen, or membership organization rates), charter rates, government or military rates, rewards program rates, incentives, meeting rates, convention rates, consolidator or interline prices, or prices available only by using a coupon, or any other rates or promotions not offered to the general public.
8. A Qualifying Lower Rate may not come from a Web site that requires you to call to get the rate, or from an email that you received.
9. A Qualifying Lower Rate may not be a rate negotiated for stays extending beyond fourteen (14) consecutive nights.
10. The Qualifying Lower Rate must be quoted and booked in U.S. dollars (without reference to currency converters). Rate disparities solely attributable to fluctuations and/or differences in currency exchange rates are excluded from the Best Rate Guarantee.
11. For room-night-only reservations, the Best Rate Guarantee applies only to the base cost, and not to taxes, gratuities, booking fees or service fees. Any charges for taxes, gratuities, booking fees or service fees in a room-night-only reservation is not considered in determining whether you have found a Qualifying Lower Rate. For comparison of packages or bundles, taxes, gratuities, booking fees and service fees are considered only to the extent necessary to make a direct comparison. For example, if the package reserved through Perfect Escapes includes taxes, gratuities, booking fees or fees in the package price, then the comparable offering from another provider must also contain the same applicable taxes, gratuities, booking fees or service fees in order to be a Qualifying Lower Rate, and vice versa.

HOW DO I INVOKE THE BEST RATE GUARANTEE?

1. To submit a refund request, you must send an email within 24 hours of your Perfect Escapes reservation and booking to support@perfectescapes.com containing the following information:

• Perfect Escapes booking confirmation number
• Your name
• Name under which room reservation was made (if different)
• Name on as stated on credit card used to make your Perfect Escapes reservation (if different from your name)
• Your email address
• Your telephone number with area code
• Hotel name
• If a room-nights-only reservation – the room type and bed type (if applicable)
• If a package or bundle reservation -- an exact description of all components of the package reserved through Perfect Escapes, and an exact description of all components of the comparable package found through another provider. If applicable, include the descriptive name of package from both Web sites.
• Check-in and check-out dates
• Rate quoted by Perfect Escapes
• Rate quoted by other provider
• Complete Web address (URL) reflecting the lower rate you found online for the same dates and hotel room or package that you purchased on Perfect Escapes.

2. To be a Qualifying Lower Rate, the lower rate must be available for booking at the time you contact us, as determined by Perfect Escapes. All requests are subject to Perfect Escapes' verification. Perfect Escapes reserves the right to deny any claims that cannot be verified by Perfect Escapes, or for which you have provided incomplete information. If we are unable to replicate the lower rate, we will request additional information and documentation (such as a screen shot) from you in order to verify the lower online rate. Please keep a copy of all such documentation. While Perfect Escapes may accept screenshots as evidence of a lower price, not all screen shots shall constitute adequate documentation of a Qualified Lower Rate. Perfect Escapes reserves the right, at its sole option, to reject refund requests where Perfect Escapes is unable to replicate a claimed lower rate, even in cases where a screen shot purporting to show the lower rate is presented to Perfect Escapes.
3. Perfect Escapes' decisions regarding refunds are final. By submitting a Best Rate Guarantee request, you fully and unconditionally agree that you are bound by these Terms and Conditions and by Perfect Escapes' decisions. Perfect Escapes will not grant any Best Rate Guarantee request that it believes, in its sole discretion, is the result of a printing or other error or is made in bad faith.
4. After we verify your claim and we receive all required documentation, you will receive a refund within thirty (30) days. The refund will be in the form of a credit to the credit card you used to pay for your Perfect Escapes reservation.

OTHER IMPORTANT INFORMATION

1. Each customer shall be limited to three (3) Best Rate Guarantee claims per customer per calendar month, regardless of the number of accounts used by the customer.
2. Notwithstanding any other provision of these Terms and Conditions, differences of less than Five Dollars ($5) between a rate booked through the PerfectEscapes.com Web site and a Qualifying Lower Rate shall not be subject to the Best Rate Guarantee and shall not be refunded.
3. The Best Rate Guarantee does not apply to reservations made by travel agents, agents or employees of travel agencies, or by agents or employees of hotels.
4. In no case shall Perfect Escapes be liable to refund any amount beyond the difference between the price you actually paid through Perfect Escapes and the Qualifying Lower Rate. You shall not be entitled to a refund of the entire amount that you paid through Perfect Escapes, if you reserve room nights through another provider and your Perfect Escapes reservation is otherwise non-cancelable pursuant to the terms of the reservation.
5. Perfect Escapes reserves the right in its sole discretion to modify or discontinue the Best Rate Guarantee or to restrict its availability to any person, at any time, for any reason, and without prior notice or liability to you. Any modification will be effective upon posting of modified Best Rate Guarantee Terms and Conditions on the PerfectEscapes.com web site. Any cancellation will be effective upon removal of references to the Best Rate Guarantee and the Best Rate Guarantee Terms and Conditions from the PerfectEscapes.com web site.
6. Perfect Escapes' failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. The terms contained in the Perfect Escapes User Agreement are incorporated and made a part of these Terms and Conditions. The Best Rate Guarantee shall be void where prohibited by law.
